Participant Waiver and Release of Liability
This Waiver and Release of Liability ("Agreement") is entered into by and between the undersigned
participant (or the participant's parent or legal guardian, if under 18) and Flow Grappling Academy ("Flow," "Academy," "we," "our," or "us") located in Port Charlotte, Florida.
By signing below, the participant acknowledges, understands, and voluntarily agrees to the following:
1. Assumption of Risk
I understand and acknowledge that participation in Brazilian jiu-jitsu, grappling, and any physical training offered by Flow Grappling Academy involves inherent risks of physical injury, illness, emotional stress, or even death. These risks include but are not limited to joint and muscle injuries, strains, sprains, fractures, cuts, bruises, concussions, and potential exposure to transmissible illnesses (e.g., COVID-19). I voluntarily assume all risks associated with my participation in any Flow Grappling Academy activities, both on and off the premises, including but not limited to classes, open mat sessions, competitions, events, seminars, and travel.
2. Waiver and Release
In consideration of being allowed to participate in any Flow Grappling Academy activity, I hereby release, waive, discharge, and covenant not to sue Flow Grappling Academy, its owners, instructors, employees, volunteers, agents, and affiliates from any and all liability, claims, demands, causes of action, or costs, including attorney's fees, arising out of or related to any injury, loss, or damage sustained by me (or my child) during or in connection with participation in Flow activities, whether caused by negligence or otherwise.
3. Medical Fitness and Treatment
I affirm that I (or my child) am physically and mentally fit to participate in martial arts and physical training. I certify that I have disclosed any known medical conditions that may affect my ability to safely train. I understand that Flow Grappling Academy is not responsible for providing medical care and authorize emergency medical treatment if necessary. I agree to be solely responsible for any resulting medical expenses.
4. Facility Rules and Conduct
I agree to follow all Flow Grappling Academy rules, codes of conduct, and instructions given by staff. I understand that Flow reserves the right to revoke access or membership at any time due to unsafe,
disrespectful, or disruptive behavior, without refund.
5. Photo, Video & Media Release
I grant Flow Grappling Academy the right to photograph, film, or record classes and events, and to use my (or my child's) likeness in promotional materials, social media, or website content, without compensation. I may opt out of media use by submitting a written request in advance.
6. Parental Consent (If Participant is Under 18)
As the parent or legal guardian of the minor named below, I acknowledge and agree to all terms above on their behalf. I understand the nature of martial arts training and voluntarily allow my child to participate. I accept full responsibility for any injury or incident that may occur.
7. Severability
If any part of this Agreement is found to be invalid or unenforceable by a court of law, the remaining
provisions shall remain in full force and effect.
8. Acknowledgment of Understanding
I have read this Waiver and Release of Liability in full. I fully understand its terms and voluntarily sign it, knowing that by doing so, I am giving up substantial legal rights. I certify that I am at least 18 years of age or am the legal guardian of a minor participant.
